The Financial Services and Markets Authority (FSMA) will monitor adherence to the new rules and devote more funds to financial literacy regarding virtual currencies.
Virtual currencies are popular nowadays, but they carry significant risks. They have no legal framework governing them, and they lack any underlying assets in the physical world. They can experience drastic price fluctuations and are vulnerable to fraud and IT-related risks.
The FSMA requested and received the authority to regulate advertisements for virtual currencies to address these risks. The new Regulation, published on March 17, 2023, in the Belgian Official Gazette, will take effect on May 17, 2023. It has three main components: accuracy and honesty in advertising, mandatory risk disclosure, and prior notification of mass media campaigns.
According to the new Regulation, advertisements must be accurate and not misleading. They must also contain mandatory information that highlights the risks involved in investing in virtual currencies. The FSMA requires all mass media campaigns to be reported at least ten days before the launch. This notification allows the FSMA to intervene if necessary before the campaign starts.
Furthermore, advertisements must contain a warning that reads, “Virtual currencies, real risks. The only guarantee in crypto is a risk.” Advertisements should not make any statements about the future value or return and should be written in understandable language.
In addition to these regulations, the FSMA will invest more in financial education, including an educational video series that appeals to young people. These videos, along with an information sheet for teachers and a quiz for pupils, make up a comprehensive lesson package on virtual currencies. In order to educate young people about the dangers of virtual money, the FSMA is also creating a game element. At the start of the upcoming academic year, the module's initial copy will be released.
In conclusion, the new advertising regulations for virtual currencies are intended to shield customers from the possible risks of making these investments. The FSMA will supervise compliance with the new regulations and invest in more financial education to help young people understand the risks involved.
