That argument draws on a unanimous Supreme Court ruling from 2025 concerning a bridge-painting contractor. The contractor secured work through false claims about meeting lower-level business requirements.

Although it completed the work, the Supreme Court rejected its argument that wire fraud required an intent to cause economic harm.

The FTX petition acknowledges that ruling but raises a separate question about admitting evidence. It argues that defendants should be allowed to present evidence disputing losses when prosecutors introduce evidence showing them. Supreme Court attorney Jeffrey Fisher told CNN that such restrictions could prejudice defendants.

However, the Justice Department described the conduct as misappropriating billions of dollars belonging to FTX customers. Prosecutors also identified $1.7 billion in investor fraud and $1.3 billion involving Alameda Research lenders.

Those amounts involved separate groups, extending the case beyond customer deposits and their eventual repayment.

FTX Repayments and Forfeiture Face Separate Scrutiny

Customer repayments proceeded through FTXs bankruptcy plan, which valued claims in dollars using November 2022 prices. Bitcoin traded around $16,000 at that time. Accordingly, the repayment framework used those historical dollar values when determining claims.

Alongside the evidence challenge, Sam Bankman-Fried contests the $11 billion forfeiture imposed in his case. His lawyers argue that the amount violates the Eighth Amendment‘s prohibition against excessive fines. The petition therefore challenges both the trial’s handling of evidence and the financial consequences of his conviction.

The Second Circuit upheld the conviction in June, rejecting arguments that preceded the Supreme Court request. The justices have given no indication that they will hear the case. The court says it grants and hears arguments in approximately 1% of cases filed each term.

Sam Bankman-Fried News: Clemency Request Remains Pending

Separately, Sam Bankman-Fried applied to President Donald Trump for clemency in June. The Office of the Pardon Attorney lists that request as pending. Its category specifies a pardon after sentence completion, although he still faces more than two decades in prison.

Trump said in January that he would not consider a pardon. The Senate later voted unanimously against clemency in July. Those developments accompany the legal challenge as SBF continues to maintain his innocence.

Bankman-Fried founded FTX in 2019, and the exchange reached a $32 billion valuation before collapsing in November 2022. Authorities arrested him in the Bahamas that December. A Manhattan jury convicted him the following year, and he withdrew a separate new-trial motion this year.
