As per court documents from January 28, Sam Bankman-legal Fried's team is requesting to have a bail restriction that banned him from using FTX funds removed.

Bankman-Fried should have access to that money held by FTX, according to a letter from Bankman-attorney, Fried's Mark Cohen, to United States District Court Judge Lewis Kaplan. The statement claims that Bankman-Fried was not previously participating in any unlawful activities .According to Nansen statistics cited by Cointelegraph, FTX and FTX US have sought roughly $659 million in unlawful payments since the cryptocurrency exchange collapsed in November 2022. Bankman-Fried disputed having any part in the deals.

Bankman-Fried was “prohibited from accessing or transferring any FTX or Alameda assets or cryptocurrency, including assets or cryptocurrency purchased with funds from FTX or Alameda,” according to the memo sent to Kaplan, as instructed by American authorities at the initial court hearing on January 3. Authorities stated at the time that a federal investigation was ongoing and that there wasn't any proof that Mr. Bankman-Fried had moved money.

“Nearly three weeks have passed since the initial pretrial conference and we assume that the Governments investigation has confirmed what Mr. Bankman-Fried has said all along; namely, that he did not access and transfer these assets,” according to the letter, the defense informed authorities.

The attorneys further contended:

“Given that the sole basis advanced for seeking that condition has not been supported, we believe that the bail condition imposed at the conference should be removed.”

The letter also responds to a request made by the United States on January 27. Bankman-Fried is forbidden by the Department of Justice from speaking with “present or past employees” of FTX or Alameda Research without his attorney. After Bankman-Fried reportedly contacted Ryne Miller, the present General Counsel of FTX US, through email and Signal on January 15, intending to “influence” Miller's evidence, the prosecutor requested the information.

Bankman-Fried is entitled to unrestricted contact with his father, therapist, and any staff or agent

of a foreign regulator, as per Cohen's letter, even when lawyers are present. According to the defense:

“For example, it would mean that Mr. Bankman-Fried could not speak to his therapist, who is a former FTX employee, without the participation of his lawyers. According to public sources, FTX and Alameda had approximately 350 employees. Each of these current and former employees could have information crucial to Mr. Bankman-Frieds defense. Requiring Mr. Bankman-Fried to include counsel in every communication with a former or current FTX employee would place an unnecessary strain on his resources and prejudice his ability to defend this case.”

FTX declared bankruptcy on November 11, 2022, and Bankman-Fried left her position as CEO. He is released on bail at his California family home and is being held on eight counts, involving money laundering and wire fraud.
