Crypto industry faces election losses: Is the CLARITY Act now at risk?

خلاصہ:Crypto industry faces setbacks after Democrats win Congress in the U.S. midterms, with Sherrod Brown returning and key crypto bills facing uncertainty.

The crypto industry has suffered major political setbacks after Democrats won control of both chambers of Congress in the November 3 U.S. midterm elections.

According to election reporting, Democrats secured majorities in the House and Senate, defeating several Republican lawmakers who supported cryptocurrency legislation. The results followed an election cycle in which crypto-linked groups spent more than $170 million backing candidates across the country.

Among the biggest developments was former Senator Sherrod Browns victory in Ohio, where industry groups had spent heavily to prevent his return.

The results could change who oversees digital asset legislation, with several prominent Democratic critics positioned to lead congressional committees.

Crypto industry loses major Senate race despite millions in spending

Brown defeated Republican Senator Jon Husted in Ohios special election, returning to Washington two years after losing his previous Senate seat.

The former Senate Banking Committee chairman has repeatedly questioned cryptocurrency regulation, consumer protections and the financial risks associated with digital assets.

His victory followed more than $64 million in crypto-related spending in the Ohio contest, according to election coverage from Crypto in America.

Earlier, crypto.news reported the industrys spending across more than 100 congressional races. By October 20, crypto-linked groups had spent approximately $176 million, with Fairshake and its affiliates accounting for much of that activity.

The Ohio contest attracted particular attention because Fairshake had previously announced a $30 million campaign against Brown.

Despite those efforts, Brown secured a Senate seat as Democrats gained control of the chamber.

Senator Elizabeth Warren, currently the Banking Committees leading Democrat, is now considered a possible successor to Republican Chairman Tim Scott.

Brown could return to a leadership position involving financial regulation, although his previous defeat complicates his standing under Senate seniority rules.

Scott is expected to become the committees ranking Republican when the next Congress takes office.

Crypto-friendly Republicans lose key House seats

The election brought further losses for Republicans who had supported legislation intended to establish clearer rules for cryptocurrencies.

Representatives Bryan Steil of Wisconsin, Zach Nunn of Iowa and Ann Wagner of Missouri lost their reelection races.

Steil chaired the House Financial Services Subcommittee on Digital Assets and had supported efforts to establish a federal framework for cryptocurrency markets.

New York Republican Mike Lawler conceded to Democrat Cait Conley, although his race remained uncalled by the Associated Press in the initial reporting.

Republican French Hill, the current House Financial Services Committee chairman, appeared positioned to retain his Arkansas seat, with the contest still awaiting a final call.

Nevertheless, Democratic control means Hill is expected to lose the committee chairmanship and become its ranking Republican.

Representative Maxine Waters, who has criticized parts of the cryptocurrency industrys regulatory proposals, is expected to return as committee chair.

Republicans retained several supporters of digital asset legislation. Nebraska Senator Pete Ricketts won reelection, while Kentucky Representative Andy Barr secured the Senate seat being vacated by Mitch McConnell.

Barr previously served on the House Financial Services Committee and could seek a position on the Senate Banking Committee.

Democrats gain control as crypto legislation faces new obstacles

The election results leave the cryptocurrency industrys unfinished legislative agenda facing a different Congress.

The Digital Asset Market Clarity Act, commonly known as the CLARITY Act, had already encountered resistance in the Senate before the election.

As previously covered, senators voted 49–50 against advancing debate on September 15, falling short of the 60 votes required.

That procedural vote did not constitute a final rejection of the legislation, but supporters failed to secure enough votes to move forward.

Democratic lawmakers had sought stronger provisions covering illicit finance, consumer safeguards and potential conflicts involving government officials with cryptocurrency interests.

Any renewed negotiations would now take place with Democrats controlling both chambers and deciding which legislation receives hearings.

Senator Kirsten Gillibrand, a Democratic supporter of cryptocurrency legislation, could gain influence following her partys Senate victories.

Her involvement could provide a negotiating channel, although the election results do not establish support for any particular version of the CLARITY Act.

Trump crypto ties could face more congressional scrutiny

Democratic control of Congress could bring additional investigations into President Donald Trumps administration and its cryptocurrency-related activities.

Representative Robert Garcia, who is expected to lead the House Oversight Committee, responded to the election results with a brief warning.

“LAWYER UP,” Garcia wrote on X on November 4.

The statement followed Democratic promises to examine the administrations business relationships, potential conflicts of interest and regulatory decisions.

LAWYER UP.

Congressional oversight could include requests for documents, public hearings and investigations involving agencies such as the Securities and Exchange Commission and Commodity Futures Trading Commission.

Questions surrounding Trumps cryptocurrency ventures could receive renewed attention as Democratic lawmakers take control of investigative committees.

Garcia has previously identified the Trump familys business dealings among the matters he wants Congress to examine.
