The Senate did not advance the Digital Asset Market Clarity Act on Tuesday, rejecting cloture on the motion to proceed by a vote of 49 to 50.

The measure needed 60 votes to overcome a procedural hurdle and fell 11 votes short.

Collins, Hawley, Moran, and Tillis broke with their party

Every yes vote came from a Republican. Four Republicans broke with their party to vote no: Maine‘s Susan Collins, Missouri’s Josh Hawley, Kansas‘s Jerry Moran, and North Carolina’s Thom Tillis.

No Democrat or independent supported the motion. Delawares Chris Coons did not cast a vote.

The vote came at 2:19 p.m. ET, recorded as Roll Call 234. A motion to proceed asks one question only: whether the Senate takes a bill up at all.

H.R. 3633 never cleared that step. No amendments, no vote on passage.

The bill would specify how oversight of digital commodities would be divided between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

It would also prohibit Federal Reserve banks from offering products directly to individuals and prevent the use of a central bank digital currency in monetary policy.
