Independent third party to review Celsius's financial records

概要:The finances of Celsius Network, which declared for Chapter 11 bankruptcy earlier this year, will be investigated by an impartial third party.

A US bankruptcy court in the Southern District of New York given approval for the case after receiving an application from the Justice Department, securities authorities, and creditors' counsel. Celsius, a cryptocurrency lender, has raised no objections to the inspection by an impartial third party.

Minority claimants, nevertheless, requested a trustee in order to continuously pay off the company's debts. In Chapter 11 bankruptcy, examiners are rarely used. The Committee for Unsecured Creditors (UCC), a consumer and creditor group, has earlier voiced fears about the expense of hiring an examiner, but recently they came to an agreement with the U.S. Trustee Program, to direct the examiner's investigation and compel them to alter their stance.

Further altering the parameters of the independent audit of the cryptocurrency lender's finances is a possibility, as per Martin Glenn, the judge handling the Celsius case.

The US Trustee made the first move to select an examiner last month. According to the US Trustee last month, the case requires an unbiased auditor due to “severe financial irregularities” and “the extensive mistrust of the Debtors' customers.”

In the meantime, the UCC is also investigating Celsius on its own.

After halting customer deposits, exchanges, and remittances in June, Celsius declared bankruptcy under Chapter 11 in July. Cryptocurrency held in Celsius accounts has become unavailable for withdrawal by users. Since then, the corporation has faced intense criticism from a number of parties involved in the proceedings due to a perceived lack of clarity and fraud-related accusations.

Blockchain.News further said Celsius sought permission from a US bankruptcy judge to discharge around US$50 million worth of cryptos that had been trapped on the platform in so-called custodial accounts, which have been set up to keep digital coins instead of earn returns.

A restricted reopening of withdrawals has been requested by Celsius, who claims that not all investors would be entitled.

About $50 million will be reimbursed to qualifying clients by Celsius. Only a tiny part of the platform's more than $200 million in locked-in custody accounts is represented by that sum.

Somewhere around 300 irate clients have submitted letters to the bankruptcy court appealing for their money back. There have been 1.7 million consumers in total who owe Celsius a total of $4.7 billion.
