Novogratz: 'Clarity Isn't Dead'

Galaxy Digital CEO Mike Novogratz says the Clarity Act still has a path forward despite months of setbacks.

“Clarity isnt dead!! Lots of negotiating over the weekend,” Novogratz wrote on X. “My instinct is the bill makes it to the floor.”

The billionaire crypto investor claims that one of the biggest remaining obstacles is the legislations government ethics language.

“It all depends on if we get the White House to move on ethics to see if we get a law,” he said.

His comments came amid signs of renewed optimism about the sweeping cryptocurrency market structure bill.

The bill is scheduled for a key procedural vote in the Senate on Tuesday, Sept. 15.

Patrick Witt, executive director of the Presidents Digital Assets Advisory Council, also struck an upbeat tone on Saturday. “Bad day to be a Clarity Act doomer,” Witt wrote on X.

Critical Tuesday vote

The Senate Banking Committee advanced the legislation in May by a bipartisan 15-9 vote. In July, lawmakers released an updated text combining work from the Senate Banking and Agriculture committees.

Another revised version of the bill was unveiled on Thursday ahead of Tuesdays vote. The roughly 630-page text contains changes dealing with decentralized finance and other issues.

However, several major disputes remain unresolved, including government ethics rules.

The Tuesday vote is not final, but clearing this major hurdle would allow the Clarity Act to move toward full Senate consideration and further amendments.

There is a narrow legislative window before the midterms, so the stakes are high.

What if Clarity fails?

Lummis, one of the leading architects of U.S. cryptocurrency market structure legislation, noted that Democratic lawmakers had already secured more than 100 requested changes.

“If the Clarity Act fails, Democrats own what comes next,” Lummis wrote on X.

She warned that failure would leave cryptocurrency users without comprehensive federal protections, disclosure requirements, and so on.

Another realistic opportunity to establish market structure rules might not come until 2030, according to Lummis.
